These Terms of Service ("Terms") govern your use of the website located at cashbuyersdirect.net and any related services (collectively, the "Services") operated by Cash Buyers Direct ("Cash Buyers Direct," "we," "us," or "our"). By accessing the Services or submitting information to us, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. About Us
Cash Buyers Direct is a real estate investment company operating out of Alpharetta, Georgia. We enter into purchase agreements directly with property owners. We may hold the property for our own account or, consistent with the terms of the agreement, assign our rights under the purchase agreement to another investor prior to closing. We are not a licensed real estate broker, agent, or lender, and we do not list property for sale on behalf of others. Any offer we extend is made in our capacity as a principal buyer or contract assignor.
2. Eligibility
To use the Services or submit a request for an offer, you must be at least 18 years old and either (a) the legal owner of the property in question, or (b) a person with documented authority to act on behalf of the owner (e.g., executor, power of attorney, authorized agent). By submitting a property for an offer, you represent that you meet these eligibility requirements.
3. Requests for Offers Are Non-Binding
Submitting your property information through the Services does not constitute a contract to sell your property, and any offer we provide in response is a non-binding expression of interest until both parties have signed a formal purchase and sale agreement. You are under no obligation to accept any offer we extend.
4. Information You Provide
You agree that all information you submit through our forms — including your name, contact details, and property information — is accurate, current, and complete to the best of your knowledge. We may rely on this information when preparing an offer. Material inaccuracies may affect the offer or our decision to proceed.
5. Electronic Communications & Consent
By providing your phone number and checking the SMS consent checkbox on our intake form, you expressly consent to receive calls and text messages (including messages sent by automated technology and prerecorded voice) from Cash Buyers Direct at the phone number you provided about your property, our offer, and this transaction. This transactional consent covers messages directly related to an offer you have requested.
If you additionally check the optional marketing consent checkbox, you also consent to receive marketing communications from Cash Buyers Direct about future property-buying opportunities and promotions. Marketing consent is optional and may be withdrawn at any time without affecting messages about a pending offer.
Consent is not a condition of any purchase or service. Transactional message frequency varies, up to 10 messages per month; marketing message frequency is up to 4 messages per month when opted in. 6. No Professional Advice
Information on the Services is for general informational purposes only and does not constitute legal, tax, financial, or real estate advice. Selling a home has significant legal and financial implications. We strongly encourage you to consult your own attorney, accountant, or financial advisor before signing any agreement.
7. Intellectual Property
All content on the Services — including text, graphics, logos, illustrations, photographs, and software — is owned by or licensed to Cash Buyers Direct and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
8. Acceptable Use
You agree not to: (a) submit false, misleading, or fraudulent information; (b) use the Services for any unlawful purpose; (c) attempt to interfere with, disrupt, or gain unauthorized access to our systems; (d) use automated tools (bots, scrapers) to access or submit forms; or (e) impersonate any person or entity.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected.
10. Limitation of Liability
To the maximum extent permitted by law, Cash Buyers Direct, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed one hundred U.S. dollars ($100) or the amount you paid us in the twelve months preceding the claim, whichever is greater.
11. Indemnification
You agree to defend, indemnify, and hold harmless Cash Buyers Direct from and against any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or breach of these Terms.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction and venue there.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be announced on the site and, where practical, by email. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the changes.
14. Termination
We may suspend or terminate your access to the Services at our discretion, without notice, if we believe you have violated these Terms. Provisions that by their nature should survive termination will do so, including intellectual property, disclaimers, and limitation of liability.
